The Element Man Terms and Conditions

When ordering goods or services through this website, you are entering into a legally binding contract with The Element Man. This contract between us shall be governed by the laws of England and Wales and any dispute will be resolved exclusively in the courts of England and Wales

Safety:

All parts supplied by The Element Man must be fitted be a competent and able person with appropriate product knowledge, and using the correct tools required. All repairs to electrical equipment must be carried out with the appliance disconnected from the mains supply. All repairs should be preceded by an electrical safety check, and the appliance should be checked again upon completion of the repair.

Ordering and Payment:

Goods are subject to availability. If, for any reason, we do not supply any goods, you will not be charged for those goods and we will refund any money that you have paid for them

Payment must be made at the time of order. Your order will only be processed once The Element Man had received payment in full. The Element Man accepts Visa, Mastercard, Delta, Switch, Cheques, Money Orders and Postal orders. Cheques will only be accepted with a valid cheque guarantee card.

Delivery:

All accepted orders made before 4:30 p.m. (GMT) are dispatched immediately for standard next day delivery using Recorded First Class Royal Mail which is included in the prices shown on this website. The Element Man cannot guarantee next day delivery for standard delivery. Guaranteed next day delivery - by 1:00 p.m. , using Royal Mail can be obtained for an extra cost of £2.00 per item. All deliveries made by Royal Mail must be signed for upon receipt. The Royal Mail will accept a signature from any person at the delivery address. Once the parcel is signed for, the responsibility for the parcel passes to the customer (not the signatory).

You are responsible for supplying your correct delivery address. Incorrectly addressed parcels, at best, will be delayed by the carrier until they have manually confirmed the delivery details. The accuracy of an address can be verified by using the Royal Mail Post Code Finder. The Element Man can not accept responsibility for delayed parcels, or for parcels that have been delivered to an incorrectly supplied address.

Should delivery be delayed by more than 21 days, you have the right to contact us at elementman@btconnect.com, or by phoning 0121-382-2305 (+44-121-382-2305), and refuse to accept the goods. The Element Man will refund any money paid by you for these goods.

Cancellation:

Orders can be cancelled up to 7 working days from the receipt of the ordered goods. All cancellations must be made in writing, either via post, fax, or email.

You are responsible for the safe return of any unwanted item(s). Your payment will be refunded once we receive the returned goods, which must be unused and in re-saleable condition.

In the event of the cancellation of any special order, you will be subject to a cancellation charge which will not exceed 50% of the value of the order. This charge will apply even if the order has not yet been dispatched.

Cost of delivery is not refundable. Where there is no separate delivery charge, you will be charged solely for the cost of the packing materials and the cost of delivering the item to you.

Incorrect Goods:

Please be aware that all items on The Element Man website are subject to design and specification changes by the manufacturer. In view of this, the item supplied may not be an exact match for the original, but has been deemed, by the manufacturer, to be a suitable alternative.

If you do receive incorrect goods from The Element Man, please contact us immediately at 0121-382-2305 (+44-121-382-2305) so that we can arrange for delivery of the correct goods as soon as possible. In this case we will provide a post paid return pack for you to return the incorrect goods. Alternatively, you can cancel your order and we will refund your payment on receipt of the returned goods.

Damaged Goods:

If goods arrive in a damaged state you must inform the Element Man within 7 days at 0121-382-2305 (+44-121-382-2305).

We will replace the goods free of charge or refund any money that you have paid for those goods. If you do not notify us within 7 days of delivery, The Element Man cannot accept responsibility for goods stated to be damaged upon delivery

Guarantee:

All parts are covered by a six month guarantee against faulty materials or workmanship. In the unlikely event of the item(s) failing please contact us by email at elementman@btconnect.com or by calling 0121-382-2305 (+44-121-382-2305) to confirm the fault and, if necessary to make arrangements for the return to the faulty item(s) for testing and repair, or replacement. You are responsible for the safe return of the goods.

Disclaimer:

All goods supplied by The Element Man must be fitted by an appropriately qualified and competent person, using the correct tools, test equipment, procedures, and whilst the appliance is disconnected from the mains supply. After repair the appliances must be checked for electrical safety.

The Element Man cannot accept responsibility for any goods that have been damaged during fitting. Goods that show signs of having been fitted will not be accepted for refund.

All prices are subject to change without notice. The Element Man does not accept responsibility for loss or damages caused by delays in delivery, incorrect fitting, modification, accident, neglect, misuse or abuse.

Always obtain a certificate of posting when returning goods by mail. The Element Man can not accept responsibility for items for returned goods that are lost in transit.

The Element Man will not accept any parcel that is sent without the correct postage. All such parcels will be treated as undeliverable by the carrier.

All Manufacturers part numbers, model numbers and information used on this website is for reference purposes only.
